These Terms of Service ("Terms") govern your access to and use of Alter TCS websites, events, and commerce services. Please read them carefully before creating an account or placing an order.

1. Acceptance of terms

  • By accessing the Alter TCS website, marketplace, or event registration portals you agree to these Terms of Service, our Privacy Policy, and any supplemental policies referenced herein.
  • If you do not agree, you must refrain from using our services. Continued use after updates take effect constitutes acceptance of the revised terms.

2. Eligibility & account integrity

  • You must be 18 years or older and capable of entering into a binding contract. Where community participation is permitted for minors, a parent or guardian must administer the account.
  • You are responsible for safeguarding login credentials. Promptly notify us at legal@altertcs.co.za if you suspect unauthorised use so we can suspend or secure the account.

3. Product listings, pricing & availability

  • All prices are displayed in South African Rand (ZAR) inclusive of VAT unless noted otherwise. We reserve the right to correct pricing or availability errors before or after an order is confirmed.
  • Pre-order release dates are estimates provided by suppliers and may shift. If fulfilment becomes impossible, we will issue a full refund.

4. Orders, payment & fraud prevention

  • Placing an order constitutes an offer to purchase. We may accept or decline the offer at our discretion, including for suspected fraudulent activity or inventory errors.
  • Payments are processed securely via PayFast. By submitting payment details you authorise PayFast to charge the order total, including applicable shipping and taxes.

5. Shipping, risk & inspection

  • Orders are dispatched via trusted courier partners within South Africa. Risk of loss passes to you upon courier confirmation of delivery.
  • Inspect deliveries promptly. Report discrepancies or transit damage within 48 hours so we can investigate with the courier and provide a remedy where appropriate.

6. Returns, cancellations & ECT Act cooling-off period

  • In accordance with the Electronic Communications and Transactions Act (ECTA), you may cancel any online transaction within 7 days of receiving goods for any reason, without penalty. You are responsible for return shipping costs unless the item is defective.
  • Sealed products must remain unopened to qualify for return. Singles and graded cards must remain in their original protective sleeves/cases. Digital codes and opened mystery boxes cannot be returned.
  • Under the Consumer Protection Act (CPA), goods found to be defective, not suitable for their intended purpose, or not matching the description may be returned, repaired, or replaced at our expense for up to 6 months after purchase.
  • Marketplace trades facilitated through Alter TCS are subject to these Terms and any additional marketplace rules communicated to participants.

7. Authenticity & quality assurance

  • Alter TCS guarantees that sealed products originate from authorised distributors. If a counterfeit item is identified, we will arrange collection and issue a full refund.
  • For grading submissions, grading outcomes are determined by third-party graders. Alter TCS is not responsible for grade disputes once the card is submitted at your instruction.

8. User conduct & community standards

  • You agree not to upload malicious code, engage in abusive behaviour, or use automated scraping without written consent.
  • Community channels (events, forums, trading spaces) require respectful conduct. We may suspend or terminate accounts that breach community guidelines or applicable law.

9. Intellectual property

  • All site content, logos, product photography, and custom software are owned by Alter TCS or its licensors.
  • You may not reproduce, adapt, or commercially exploit content without prior written permission, except as allowed under fair dealing.

10. Warranties & liability

  • To the maximum extent permitted by law, services are provided on an "as-is" and "as-available" basis without warranties of uninterrupted availability or suitability for a particular purpose.
  • Alter TCS is not liable for indirect, incidental, or consequential damages. Our aggregate liability is limited to the amount paid for the affected order or service.

11. Indemnity

  • You agree to indemnify and hold Alter TCS, its directors, and employees harmless from claims arising out of your breach of these Terms, misuse of the services, or violation of law.

12. Data protection & POPIA compliance

  • We process your personal information in accordance with the Protection of Personal Information Act (POPIA). By using our services, you consent to the collection and processing of personal data as outlined in our Privacy Policy.
  • You have rights under POPIA to access, correct, and delete your personal information. We implement appropriate security measures to protect your data and will notify you of any security breaches as required by law.

13. Compliance with law

  • These Terms are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the courts of Cape Town, Western Cape for disputes that cannot be resolved amicably.
  • Nothing in these Terms limits your statutory rights under the Consumer Protection Act (CPA), Electronic Communications and Transactions Act (ECTA), or Protection of Personal Information Act (POPIA).

14. Changes to these Terms

We may amend these Terms to reflect legislative updates, operational changes, or new features. Material changes will be communicated via email to registered users and via a site notice at least 7 days before they take effect.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
